Agreement to these terms
By downloading, accessing, or using Horse Racing Companion, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the service.
The app is also subject to Apple’s Standard Licensed Application End User License Agreement. These terms supplement that agreement and do not replace any non-waivable rights it provides.
Eligibility and lawful use
You must be at least 18 years old and of legal wagering age in the place where you use the app. You may use the app only where its informational features and any wagering activity you independently choose are lawful. You are responsible for complying with venue rules, racing regulations, and applicable law.
Do not use the app if you are prohibited from wagering, are participating in a race in a capacity that restricts wagering, or would violate an employer, racing authority, or venue rule.
What the service does—and does not do
Horse Racing Companion provides independent informational analysis of public horse-racing data. It may display race cards, odds, scratches, changes, preliminary or final recommendations, confidence labels, suggested tickets, and historical results.
Horse Racing Companion is not a wagering operator.
It does not accept deposits, hold funds, create betting accounts, sell wagering credits, place or transmit bets, or receive a share of a wager. It is not affiliated with, endorsed by, or sponsored by Del Mar Thoroughbred Club.
Recommendations and your decisions
Recommendations are estimates based on available information and model assumptions. Racing is uncertain. Data can be delayed, incomplete, incorrect, or change after a recommendation. A Low, Medium, or High confidence label describes the clarity of the available information; it is not a probability of winning. No recommendation guarantees a result or profit.
A preliminary recommendation can change as current odds, scratches, or other race information changes. A final recommendation may still lose. The app may show no bet when a field is unusually unclear or when missing, delayed, or changed data prevents a safe ticket.
You alone decide whether to wager, what to say to a teller, whether a ticket is correct before accepting it, and how much you can afford to lose. Always confirm the track, race, bet type, horse program numbers, base amount, combinations, and total on the issued ticket before leaving the window.
Free days and season passes
The app includes three free Del Mar racing days. A free day is used only when you intentionally activate an eligible live racing date. Access rules shown in the app at the time of activation control.
After the three free days are used, continuing live recommendations for the named season requires a non-renewing in-app purchase. The U.S. price is $19.99, but the price shown by the App Store at confirmation controls and may vary by region or tax. The pass does not renew automatically.
Payment is processed by Apple and charged to your Apple Account after confirmation. Purchase history, refunds, and billing issues are managed by Apple under its terms. Restore Purchases requires the same Apple Account and a transaction Apple makes available for verification. A pass unlocks eligible app features; it does not guarantee a recommendation, winning wager, minimum number of tickets, uninterrupted data, or financial return.
Data and service availability
We may change, suspend, limit, or discontinue features, data sources, tracks, supported dates, models, or access when reasonably needed for safety, accuracy, maintenance, legal compliance, or product development. Live information may be unavailable because of network, source, venue, device, or service conditions.
We may correct errors and invalidate a recommendation when a scratch, stale price, incomplete ticket, or other safety condition is detected. Historical displays may be revised to reflect official corrections while preserving the originally frozen decision where appropriate.
License and acceptable use
Subject to these terms and Apple’s Standard EULA, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app for lawful, noncommercial purposes.
You may not attempt to bypass access controls; automate abusive requests; interfere with the service; misrepresent the app as official; copy or resell substantial app content; reverse engineer except where law expressly permits; or use the app, data, or recommendations to violate law or another person’s rights.
Intellectual property and third parties
The app’s original software, design, branding, explanations, and model presentation are owned by Brett Pollak or licensed providers. Track names, horse names, and other third-party marks remain the property of their respective owners and are used only for identification and informational purposes.
Links or data from third parties do not imply endorsement. Third-party services are governed by their own terms and may change without notice.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, or wagering outcome.
To the maximum extent permitted by law, Brett Pollak and Horse Racing Companion will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost winnings, lost profits, or wagering losses; an incorrect or rejected ticket; or loss arising from delayed, missing, or inaccurate data. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded.
You agree to use reasonable care, verify every issued ticket, and stop using the app if you cannot do so responsibly.
Termination
You may stop using the service at any time. We may suspend access for abuse, fraud, security threats, unlawful use, or material violation of these terms. Provisions that by their nature should survive termination—including ownership, disclaimers, and limitations—will survive.
Governing law and changes
These terms are governed by California law, without regard to conflict-of-law rules, except where your local consumer law requires otherwise. We may update these terms as the service or legal requirements change. Continued use after an updated effective date means you accept the revised terms.
