Agreement to these terms
By downloading, accessing, or using Horse Racing Companion, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the service.
The app is also subject to Apple’s Standard Licensed Application End User License Agreement. These terms supplement that agreement and do not replace any non-waivable rights it provides.
Eligibility and lawful use
You must be at least 18 years old and of legal wagering age in the place where you use the app. You may use the app only where its informational features and any wagering activity you independently choose are lawful. You are responsible for complying with venue rules, racing regulations, and applicable law.
Do not use the app if you are prohibited from wagering, are participating in a race in a capacity that restricts wagering, or would violate an employer, racing authority, or venue rule.
What the service does and does not do
Horse Racing Companion provides independent race picks based on public horse-racing data. It may display race cards, odds, scratches, changes, early or final picks, explicit pick-type labels such as Win, Place, or Show, pick confidence, a rough estimated total return for the track’s minimum stake using current odds, and comparisons of saved pre-race picks with official results.
Horse Racing Companion is not a wagering operator.
It does not accept deposits or wagering funds, hold a wagering balance, create betting accounts, sell wagering credits or virtual currency, execute or transmit wagers, connect to a betting operator, settle a user wagering account, or receive a share of a wager. Any wagering transaction and exchange of wagering funds happen outside the app. It is not affiliated with, endorsed by, or sponsored by Del Mar Thoroughbred Club.
Picks and your decisions
Picks are estimates based on available information and the app’s analysis. Racing is uncertain. Data can be delayed, incomplete, incorrect, or change after a pick. The confidence meter describes how clearly the available information supports the pick; it is not a probability of winning. No pick guarantees a result or profit.
An early pick can change as current odds, scratches, or other race information changes. A final pick may still lose. When the leaders are unusually close, the app keeps its top-ranked horse visible with Low confidence. It may show no pick when required information or history is insufficient, a final check cannot be verified, or a late scratch leaves no safe time for a replacement.
You alone decide whether to wager and how much you can afford to lose. The app does not provide teller wording, betting-window instructions, an adjustable stake control, or a mechanism to place or transmit a wager. Any wagering decision and transaction occur independently outside the app.
Free days and season passes
The first three Del Mar racing days intentionally unlocked on an installation are complimentary. After those days are used, the app may offer a non-renewing season pass that unlocks race-day picks for the Del Mar season and end date displayed before purchase. The app and App Store show the exact price and covered period before confirmation. The pass does not renew automatically.
Payment is processed by Apple and charged to your Apple Account after confirmation. Purchase history, refunds, and billing issues are managed by Apple under its terms. Restore Purchases requires the same Apple Account and a transaction Apple makes available for verification.
A pass buys access to app picks only. It is not a deposit, wagering balance, betting credit, virtual currency, or payment method for a wager. It does not guarantee a pick, winning wager, minimum number of picks, uninterrupted data, or financial return.
Data and service availability
We may change, suspend, limit, or discontinue features, data sources, tracks, supported dates, analysis, or access when reasonably needed for safety, accuracy, maintenance, legal compliance, or product development. Live information may be unavailable because of network, source, venue, device, or service conditions.
We may correct errors and withdraw a pick when a scratch, outdated price, incomplete data, or other safety condition is detected. Historical displays may be revised to reflect official corrections while preserving the pick saved before the race where appropriate.
License and acceptable use
Subject to these terms and Apple’s Standard EULA, you receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app for lawful, noncommercial purposes.
You may not attempt to bypass access controls; automate abusive requests; interfere with the service; misrepresent the app as official; copy or resell substantial app content; reverse engineer except where law expressly permits; or use the app, data, or picks to violate law or another person’s rights.
Intellectual property and third parties
The app’s original software, design, branding, explanations, and analysis presentation are owned by Brett Pollak or licensed providers. Track names, horse names, and other third-party marks remain the property of their respective owners and are used only for identification and informational purposes.
Links or data from third parties do not imply endorsement. Third-party services are governed by their own terms and may change without notice.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, or wagering outcome.
To the maximum extent permitted by law, Brett Pollak and Horse Racing Companion will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost winnings, lost profits, or wagering losses; or loss arising from delayed, missing, or inaccurate data or estimates. Nothing in these terms excludes liability or consumer rights that cannot lawfully be excluded.
You agree to use reasonable care and stop using the app if you cannot do so responsibly.
Termination
You may stop using the service at any time. We may suspend access for abuse, fraud, security threats, unlawful use, or material violation of these terms. Provisions that by their nature should survive termination, including ownership, disclaimers, and limitations, will survive.
Governing law and changes
These terms are governed by California law, without regard to conflict-of-law rules, except where your local consumer law requires otherwise. We may update these terms as the service or legal requirements change. Continued use after an updated effective date means you accept the revised terms.
